Spain: Google, search and data protection

Google and Spanish data protection authority have appeared at the European Court.

Lawyers representing the Spanish data protection authority on one side, and Google on the other, met in the European Court this week.

The case focuses on whether Google should refrain from publishing any information that may breach an individual's right to privacy.  Google is arguing that it should not be required to erase what is lawful content.

The court must consider whether search engines are hosts or controllers of the information displayed in search results.
